

Health Poverty Action (HPA), with funding from [MHNP project] invites all suppliers to participate in tendering for the supply of [soft rice].
1. Institution introduction.
Health Poverty Action (HPA) was founded in 1984 and is a UK-based international NGO working on development and humanitarian relief. HPA started its programme in Myanmar in 1994 in Kachin. Current project areas in Myanmar cover almost the whole of the Myanmar-China border area. In 2012, HPA registered with the Ministry of Homeland Affairs and signed a Memorandum of Understanding (MoU) with the Ministry of Health and Sports in 2013. In 2017, HPA was registered in China and has been managed under Health Commission of Yunnan Province.
In Kachin, HPA has more than 28 years of working history. After 17 years of fragile ceasefire, the conflict in Kachin State resumed with heightened intensity on 9th June 2011, which led to a declaration of war on 13th June 2011. Intensified fighting had caused hundreds of casualties on both sides, significant damage to infrastructures and the displacement of almost 50,000 civilians along the Sino-Burma border.
Shortly after the outbreak of the armed conflict, HPA started an emergency project from June 2011 to May 2012. The main activities focused on emergency aid to Internally Displaced People (IDP), including, shelter, food, health, WASH and etc. After June 2012, HPA continued humanitarian relief efforts till 2016. During the period, HPA worked with partners and local authorities to cope with the chronic humanitarian situation in Kachin. From 2016 to the end of 2020, HPA continues delivering humanitarian support and addressing emerging issues, such as COVID-19. From 2021, HPA started to address the challenges and opportunities of a prolonged COVID-19 pandemic, worsening local economic and livelihood environment and emerging initiatives of return and resettlement. After February 2021, HPA started to closely monitor the evolvement of the humanitarian situation in Kachin and had been working with WFP, local NGOs as well as donors to handle the COVID-19 outbreak and food gap issues.

3. The tender's qualification requirements
The bidders participate in this tender shall meet the following conditions:
①There are independent legal institutions with legal qualification in the operating country or local area (such as business licenses, organization code certificates, registration certificate for private non-profit organizations, etc.);
②With good commercial reputation and sound financial accounting system, the financial situation is good, and there is not in the state of property being taken over, frozen, bankrupt;
③Within 3 years prior to the bidding, there were no major illegal records in the business activities, and there was a good record of paying taxes and social security funds according to law.
4. Bidding documents and explanations
(1) Bidding documents: Bidders shall submit 2 sets of complete tender documents in writing form in accordance with the above tender content, comply with the following requirements, and bidders shall provide the bidding documents and materials as required in all bidding documents:
① Rice quality inspection report and a small bag of rice sample.
② Reference letter from other cooperating parties.
③ Duplicate of enterprise business license, copy of account opening license, identification of legal representative, and power of attorney of the legal representative shall be stamped with the official seal.

(2) Bidding method and deadline
Bidders should mail or express paper bid documents to HPA Yunnan Representative Office before 17:00 on November 2nd, 2022 (depend on the time of receipt of the bid documents) (see contact details below). The tender documents will not be accepted which received after the tender deadline.
(3) Sealing and marking of bid documents
① The bidder shall seal the bid documents in an envelope and seal them with the official seal or signature at the seal. The bid documents will be opened at the bid evaluation site.
② The bidding document envelope seal should indicate: the bidder unit name, address, telephone number and contact name of the bidder, and indicate the words "can be unsealed when opening the bid" and "original".
(4) Bidding instructions
① All bidding documents and related matters in this tender are the commercial secrets of the bidding unit. The bidding company or institution shall not disclose it to a third party for any reason or in any way without the written permission of the tenderer. Otherwise, the bidding unit will pursue the relevant legal responsibilities.
② Bidders shall bear any expenses arising from this bid.
③ Bidders shall comply with the attached annexes of Health Poverty Action (UK) Yunnan Representative Office, annex P18 “HPA General Terms & Conditions for Procurement of Goods & Services”, annex P19 “HPA Code of Ethics”, annex P24 “HPA RFT Conditions of Participation”
5. Bid evaluation and contract signing
(1) HPA (UK) Yunnan Representative Office will organize the bid evaluation after the bid deadline, notice the winning bidder at the end of November 2022 and negotiate and sign the contract. Those who have not won the bid will be notified by email from HPA (UK) Yunnan Representative Office.
(2) The tenderee has no obligation to accept the lowest bid price.
(3) After the bid evaluation, the tenderee will notify the winning bidder and unsuccessful bidders, but will not explain the bid evaluation process and the results.
(4) The winning bidder shall enter into commercial negotiations with the bidding unit and sign a contract with them within the specified time.
(5) The final signed purchase contract shall be based on the actual quantity and amount signed by the winning bidder and HPA.
6. The rights of the tenderee
The right to explain this bidding document belongs to the tenderee.
